Here are some police ethics cases about driving a vehicle with a lack of caution or discernment and the way we handled them.
A complaint concerns an intervention carried out with Mr. X, on July XX, 20XX. More specifically, he complains that the police encroached on his lawn with their patrol vehicle and that they did not apologize.
The information collected during our verifications allow us to understand the circumstances surrounding the events reported in the complaint. The road where Mr. X lives is said to be very narrow, which may have forced the police to encroach somewhat on his land during their intervention. This complaint was therefore denied.
The complainant criticized the police for not having turned on the flashing lights of their vehicle in order to notify their son that they were intercepting him. The complainant's son alleged that he saw a car coming very quickly behind him, it was evening, he didn't know it was the police so he got scared and started to speed up. When the flashing lights came on, he mentions having slowed down.
In this case, the Commissioner decided to refer the file to conciliation since it is alleged that the driver of the emergency vehicle did not drive with caution and discernment.
It is about an acknowledgment of responsibility, that is to say that the following account is confirmed by both the citizen part and the police part, the police officer acknowledging having committed certain faults:
Officer X was responding to an emergency call and heading towards a busy intersection. They were traveling at excessive speed and entered the opposite direction in the opposite lane in order to bypass three vehicles stopped at a red light, before crossing an intersection, still at a red light, without slowing down. In addition, their visibility was obstructed and double lines on the roadway prohibited overtaking at the place of his maneuver. The collision that occurred involved three other vehicles.
This complaint was referred to an investigation because of the seriousness of the alleged acts and the consequences resulting from these acts. The police party admitted its responsibility in the event. The Tribunal administratif de déontologie policière recognized them as derogatory and imposed a disqualification sanction of 28 months because the police officer was retired.
