What happens if I am cited before the Tribunal administratif de déontologie policière (Administrative Tribunal for Police Ethics)?

When you are cited before the Tribunal administratif de déontologie policière (Administrative Tribunal for Police Ethics), you must submit a statement admitting or denying the charges within 7 days of being notified of the citation. 

After submitting your statement, you will be notified of the date and location of the hearing at least 30 days in advance.

The hearing may be held anywhere in Québec and is open to the public, unless the Tribunal orders that the hearing be held in camera.

You have the right to be assisted or represented by a lawyer.

At the hearing, you will have the opportunity to be heard and to present a full and complete defense. You will be able to cite any witnesses you wish to call and produce any documents that may be useful to your defense.

Following the hearing, the Tribunal issues a written, reasoned decision, which it forwards to the parties within 10 days. 

If the Tribunal concludes that the evidence presented before it is insufficient to support the charges brought by the Commissioner, it will render a decision confirming that you have not contravened the Code of Ethics of Québec Police Officers.

If the Tribunal determines that you have violated the Code of Ethics of Québec Police Officers, a new hearing will be held to determine the appropriate sanction. You will have the opportunity to make representations regarding the sanction that should be imposed.

 

What can I do if I object to the decision rendered by the Tribunal de déontologie policière?

You may request permission to appeal any final decision of the Tribunal. This request must be made to the clerk's office of the Court of Québec within 30 days of the decision. 


If a sanction is to be imposed, a request for permission to appeal can only be made once the sanction has been pronounced.
